1. General terms and conditions

1.1. Overview

These Sofware Service Terms ("Terms") govern your use of the digital services provided by Scienfy ("Service"). By using the Service, you agree to be bound by these Terms. The present General Conditions are applicable to the services of Scienfy, as well as the Specific Conditions corresponding to each of the subscription plans.

1.2. Publication and Licensing Rights

Subject to these Terms, Scienfy grants you a limited, non-exclusive, non-transferable license to use the Service for the term of your subscription. The licence of use and exploitation will depend on the contracted subscription (for more information see sections 2.1, 2.2, 2.3, and 2.4). The rights of the creation made with Scienfy are personal and non-transferable. Its sale or distribution to third parties is not permitted. The scope of use of Scienfy creations is limited to the scientific field.

Only Scienfy users subscribed to a plan will be able to request a licence by filling in the 'Request rigths' form. Individual', 'Lab' and 'Premium' plans can request unlimited licences by following the specific terms of use. The 'Weekly' plan only allows one request. If you request more licences than allowed or if you request them without being a subscriber, an extra charge of €30 will be applied.

1.3. Restrictions

You may not use the Service for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission of Scienfy.

1.4. Intellectual property

The Service and its original content, features, and functionality are owned by Scienfy and are protected by international copyright, trademark, and other intellectual property or proprietary rights laws.

1.5. Payment

You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. All payment obligations are non-cancelable, and all amounts paid are non-refundable.

1.6. Cancellation

We understand that circumstances may change, and you may need to cancel your subscription. Please take note of our cancellation policy outlined below:

1. 6.1. Monthly Subscription
a. You can cancel your monthly subscription at any time during the billing cycle.
b. To cancel, please log in to your account on our website/app and navigate to the "Subscription" section.
c. Upon cancellation, your subscription will remain active until the end of the current billing cycle.
d. No refunds or partial refunds will be provided for the unused portion of the current billing cycle.

1. 6.2. Annual Subscription

a. You can cancel your annual subscription within the first 30 days from the date of purchase and receive a full refund.
b. After the initial 30-day period, the subscription fee is non-refundable.
c. To cancel, please contact our customer support team via email or phone, providing your subscription details and the reason for cancellation.
d. Upon cancellation, your subscription will remain active until the end of the current subscription period.
e. No refunds or partial refunds will be provided for the unused portion of the subscription.

Please note that all cancellation requests must be received before the next billing cycle or subscription period to avoid charges for the upcoming cycle. We recommend canceling at least 48 hours in advance to ensure the cancellation is processed successfully

1.6. Termination

Scienfy may terminate your access to the Service, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

1.7. Disclaimer of warranties

The Service is provided "as is". Scienfy makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

1.8. Limitation of liability

In no event shall Scienfy be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Service, even if Scienfy has been notified orally or in writing of the possibility of such damage.

1.9. Entire agreement

These Terms constitute the entire agreement between you and Scienfy regarding the use of the Service.

2.1. Specific terms and conditions of Weekly Plan

2.1.1. Publication and Licensing Rights of Weekly Plan

The 'Weekly plan' subscription plan includes publication rights for scientific journals, theses, posters, or any other scientific format. The rights are personal and non-transferable. No exploitation outside the scientific field is permitted without express authorisation from Scienfy.

2.1.2. Use restrictions of Weekly Plan

This plan only allows use by a single user.

2.2. Specific terms and conditions of Individual Plan

2.2.1. Publication and Licensing Rights of Individual Plan

The 'Individual plan' subscription plan includes rights to publish in scientific journals, presentations or scientific posters. Their use to illustrate theses or similar documents is prohibited. The rights are personal and non-transferable. No exploitation outside the scientific field is permitted without express authorisation from Scienfy.

2.2.2. Use restrictions of Individual Plan

This plan only allows use by a single user. Transfer of the account to other users is not allowed.

2.3. Specific terms and conditions of Lab Plan

2.3.1. Publication and Licensing Rights of Lab Plan

The 'Lab plan' subscription plan includes rights to publish in scientific journals, presentations or scientific posters. Their use to illustrate theses or similar documents is prohibited. The rights are personal and non-transferable. No exploitation outside the scientific field is permitted without express authorisation from Scienfy.

2.3.2. Use restrictions of Lab Plan

This plan only allows up to 5 users from 1 single laboratory.

2.3.3. On-demand models

The included model-on-demand service may be denied if the requested design is too complex or requires additional resources. Scienfy reserves the right to decide whether the requested model is granted or denied. All customised resources will be of a "public" nature. In this way, they will be included in the Scienfy database and other users will be able to use them. There is an extra charge for obtaining "private" figures.

2.4. Specific terms and conditions of Premium Plan

The 'Premium plan' subscription plan includes rights to publish in scientific journals, theses, presentations or scientific posters. The rights are personal and non-transferable. No exploitation outside the scientific field is permitted without express authorisation from Scienfy.
